Welcome to Artifact MokUP! The terms “we”, “our” and “us” refer to JuCaUp, a sole proprietorship whose registered office is located at Le Bourg, 43340 Saint-Haon, France. Registered with the Répertoire des Métiers du Puy-en-Velay.
JuCaUp operates the Artifact MokUP store and the website https://artifactmokup.fr, including all information, content, features, tools, products and related services in order to provide you, as a customer, with a personalized shopping experience (hereinafter the “Services”).
The store is powered by Shopify, which enables us to provide the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Use (hereinafter the “Terms”) as well as our Privacy Policy.
1. Access and Account
- You represent that you are at least the legal age of majority in your country of residence.
- You agree to provide accurate, complete and up-to-date information when creating your account or placing an order.
- You are responsible for maintaining the confidentiality of your login credentials. Any activity carried out through your account is deemed to be performed by you.
- It is prohibited to transfer, assign or sell your account.
2. Products
- We make every effort to accurately present our products. However, colors, textures and dimensions may vary depending on screens or devices.
- We do not guarantee that the products will precisely meet your expectations.
- We reserve the right to modify or remove a product without prior notice.
3. Orders
- Any order placed constitutes an offer to purchase. It is only formed after our confirmation by email and receipt of payment.
- We reserve the right to cancel any order in the event of an obvious error, fraud, or an issue with stock/payment.
- The return and refund conditions are described in our Refund Policy.
4. Prices and Billing
- Prices are indicated in euros inclusive of all taxes (TTC).
- Shipping costs and any local or customs taxes are added at the time of ordering.
- You agree to provide valid and authorized means of payment.
- In the event of a manifest pricing error, we reserve the right to cancel the order.
5. Shipping and Delivery
- Delivery times are indicated to the Customer before order confirmation. They are provided for information purposes only. In any case, delivery will occur within a maximum period of 30 days from the order date.
- Risk transfers at the moment the Customer takes physical possession of the product, i.e., upon parcel handover.
- In the event of a damaged parcel, the Customer must make all necessary reservations with the carrier within 3 business days from receipt (Article L.133-3 of the French Commercial Code). Regardless of these steps, the Customer retains the benefit of the statutory conformity warranty provided for in Articles L.217-3 et seq. of the French Consumer Code.
6. Intellectual Property
- All website content (texts, images, graphics, logos, videos, etc.) is the exclusive property of JuCaUp, unless otherwise stated.
- Any reproduction, distribution or exploitation without authorization is prohibited (Articles L.111-1 et seq. of the French Intellectual Property Code).
7. Third-Party Tools and Services
- We may offer tools or services provided by third parties (e.g., Shopify modules).
- These tools are provided “as is” and under the responsibility of the third-party providers.
- Your use of these tools is at your own risk.
8. External Links
- Our site may contain links to third-party websites.
- We are not responsible for the content, practices or products offered by these websites.
9. Relationship with Shopify
Artifact MokUP is powered by Shopify, but sales are concluded directly with JuCaUp.
You acknowledge that Shopify is not a party to the transaction and assumes no responsibility related to your purchases on our store.
10. Privacy Policy
Your personal data are processed in accordance with our Privacy Policy.
Certain data are also processed by Shopify (host and technical service provider).
11. Returns and Refunds

12. Prohibited Uses
You agree not to use the Services:
- for fraudulent, illegal, defamatory or harmful purposes,
- to transmit viruses or malicious code,
- to interfere with the operation of the site.
Any violation may result in suspension or deletion of your account.
13. Termination
We may suspend or terminate access to our Services in the event of non-compliance with the Terms.
Certain provisions (intellectual property, confidentiality, limitations of liability, etc.) will continue to apply after termination.
14. Limitation of Liability
- To the extent permitted by law, JuCaUp shall not be liable for indirect damages, loss of profit or business arising from the use of the Services.
- We do not warrant that the site will be error-free or uninterrupted.
- These limitations do not apply in cases of gross negligence, willful misconduct or failure to perform an essential obligation.
15. Indemnification
You agree to indemnify us against any claim or damage arising from your use of the Services in violation of these Terms or of the law.
16. Governing Law and Jurisdiction
These Terms are governed by French law.
In the event of a dispute, the consumer may bring an action, at their choice:
- before the court of their place of residence,
- or before the court of the place of delivery of the product (Article R.631-3 of the French Consumer Code).
17. Changes to the Terms
We may modify these Terms at any time. The applicable version is the one published on the site on the day of your use or order.
